Dumpster Rental Agreement

In this agreement, "COMPANY" means LPC Removal Service (JunkPickup.com), and "CUSTOMER" means the person or business renting the dumpster.

Containers

All containers furnished by the COMPANY remain the property of the COMPANY. CUSTOMER shall not modify the containers or use them for any purpose other than the COMPANY's service. CUSTOMER shall not move, transport or otherwise relocate the container(s) while in CUSTOMER's possession. Customers may not hire a third party to crush, smash or incinerate anything once it is inside the dumpster. Upon 24 hours' notice, COMPANY will relocate the container on the premises for a service charge of $200. CUSTOMER accepts responsibility and liability for any loss of, or damage to, the container(s) while in CUSTOMER's possession. CUSTOMER shall provide a suitable site for the container(s) and grant the COMPANY access to the container(s) at all reasonable times.

An additional charge of $200 applies if: (a) the container is unserviceable because CUSTOMER did not provide access and a return trip is required for pickup, or (b) the driver arrives for a requested pickup and CUSTOMER asks that the dumpster not be taken (even if it is within the original rental period). Federal, state and local laws govern the transportation and gross vehicle weight of over-the-road vehicles. Construction and demolition debris may be loaded only to the top of the container ("fill line"). If COMPANY is unable to tarp a container because it is overfilled, or it is unsafe to transport, COMPANY has the right to dump all or part of the load on site.

Customer's responsibility for the container

The container shall be in the possession and control of CUSTOMER. CUSTOMER agrees to hold harmless and indemnify COMPANY against all claims, lawsuits and any other liability for injury to persons or damage to property arising out of the possession or use of the equipment by CUSTOMER. CUSTOMER is responsible for the cleanliness and safekeeping of the equipment and for any and all damage from the time the equipment is delivered until it is picked up. This includes, but is not limited to, fire, theft, vandalism, negligence, graffiti, natural disaster or other activity that causes damage. CUSTOMER shall not overload the equipment or use it for incineration, and is liable to COMPANY for loss or damage beyond reasonable wear and tear. CUSTOMER shall not overload any roll-off container or cause it to be overweight. If COMPANY is fined for an overweight container loaded by CUSTOMER or CUSTOMER's designates, CUSTOMER shall pay the fine and any related expense.

Placement, property and access

COMPANY is not liable for any damage to CUSTOMER's pavement or driveway surface resulting from the roll-off container or the COMPANY truck servicing it. If CUSTOMER requests placement of the container on grass or dirt, COMPANY is not liable for any damage to those surfaces by the truck or container. CUSTOMER must ensure a minimum of 15 feet of overhead clearance from all power, phone, cable and other lines. CUSTOMER releases COMPANY and shall indemnify, defend and hold harmless COMPANY against all claims for damage to property arising out of CUSTOMER's use, operation or possession of the container. If the driver believes a placement will cause damage to property, the container or vehicles, the driver may refuse that placement and suggest a more suitable location.

COMPANY places containers on private property, not in the street. CUSTOMER is responsible for any permit that may be required and agrees to pay any fines or fees associated with obtaining a required permit, or with moving the dumpster if a required permit was not obtained. The move fee is $200.

COMPANY is not liable to CUSTOMER for failure to perform the services because of events beyond its control, including but not limited to fires, floods, governmental actions, changes in law, weather, traffic or acts of God.

Weight limits

Each dumpster size includes a weight allowance (10 Yard Dumpster: 1.5 tons included; 15 Yard Dumpster: 2 tons included; 20 Yard Dumpster: 3 tons included). Any load over the allowance is billed at $225 per ton, prorated to the pound. If a load exceeds the legal limits of the container or vehicle, CUSTOMER must remove enough weight to bring the load into legal compliance. If CUSTOMER refuses, COMPANY may dump all or any portion of the load on site.

Waste materials

CUSTOMER warrants that the materials placed in the container will not contain any hazardous, toxic, radioactive or other substance prohibited by applicable federal, state or local laws or regulations. CUSTOMER agrees to indemnify, defend and hold harmless COMPANY against all claims, costs, attorneys' fees, damages, suits, penalties, fines and liabilities for injury or death to persons, or loss or damage to property or the environment, arising out of a breach of this warranty. The warranties and indemnities in this agreement survive its termination.

Surchargeable items (Massachusetts waste ban items and propane tanks): TVs / CRTs $50; Mattresses / box springs $100; Appliances with Freon (fridges, freezers, AC units, dehumidifiers) $50; Other appliances not placed on top of the load or at the back door $50; Tires $25; Propane tanks $25. Prices are subject to change and are posted on our website.

Yard waste (brush, grass, leaves and similar) may not be mixed with other debris. It is accepted only in a dumpster rented for yard waste alone. Do not load asphalt, concrete, rock, brick or dirt into the container; contact COMPANY about how to handle and recycle these materials.

Hazardous materials

No liquids, batteries, paint, toxic materials, oils, hazardous waste, explosives, pressurized containers of any kind, or any items restricted by city, state or federal agencies with jurisdiction over the area.

Pickup schedule and extra days

The container will be picked up at any time of day on the 14th day of the rental period unless CUSTOMER has made other arrangements. After the rental period ends, an additional rental charge of $10 per day applies. If the container cannot be picked up because the load is too large, CUSTOMER must remove a portion of the load. If the excess debris is not removed, COMPANY may dump the excess on site in order to collect the container.

Charges

All charges, including any weight overages, surchargeable items, extra days and fees in this agreement, will be billed to CUSTOMER or charged to the card on file.
