CONTAINERS: All containers furnished by the COMPANY shall remain the property of the COMPANY and customers SHALL not modify or use the containers for any purpose other than relating to the COMPANY’S service. CUSTOMER shall not move, transport or otherwise relocate the container(s) while in the CUSTOMER’S possession. Customers are not allowed to hire a third party to crush, smash or incinerate anything once it’s inside of the dumpster. Upon 24 hours’ notice, COMPANY shall relocate the container on the premises for a service charge of $200. CUSTOMER accepts responsibility and liability for any loss of, or damage to the container(s) while in CUSTOMER’S possession. CUSTOMER shall provide a suitable site for the container(s) and grant the COMPANY the right to access to the container(s) at all reasonable times.
Additional charge of $200 will apply if: (a) container(s) are unserviceable due to CUSTOMER’S failure to provide access and a return trip is required for pickup, or (b) driver arrives for requested pickup and customer requests dumpster not be taken (even if it is within the original rental period). Federal, state and local laws govern the transportation and gross vehicle weight of over-the-road vehicles. Construction and Demolition debris may be loaded to the top “FILL LINE – GENERAL DEBRIS” of the roll off container. If company is unable to tarp a container due to overfill or if unsafe to transport, COMPANY has the right to dump all or part of the load on site.
CUSTOMERS RESPONSIBILITY FOR CONTAINER. The container shall be in the possession and control of the Customer. Customer agrees to hold harmless and indemnify the Contractor against all claims, lawsuits, and any other liability for injury to persons or damage to property arising out of the possession or use of the equipment by the Customer. Customer shall be responsible for the cleanliness and safekeeping of the equipment and is responsible for any, and all damage from the time the equipment is delivered until it is returned. This includes but is not limited to fire, theft, vandalism, negligence, graffiti, natural disaster, or other activity which causes damages. Customer shall not overload the equipment, nor use it for incineration purposes, and shall be liable to Contractor for loss or damage in excess of reasonable wear and tear. Customer shall not overload or cause to be overweight, any Roll-off container provided by the Contractor. In the event an overweight fine is sustained by the Contractor transporting a Roll-off container loaded by the Customer or its designates, Customer shall incur the cost of any fine and expense.
COMPANY shall not be liable for any claims for damage to CUSTOMER’S pavement or driveway surface resulting from the roll-off container or COMPANY truck servicing the container. If CUSTOMER requests placement of container on any grass or dirt surface, COMPANY is not liable for any damages to such surfaces by truck or container. CUSTOMER must assure a minimum of 15’ overhead clearance for all power, phone, cable, and other lines. CUSTOMER releases COMPANY, and shall indemnify, defend and hold harmless COMPANY against all claims, damage to property arising out of CUSTOMER’S use, operation or possession of the container. COMPANY shall not be liable to CUSTOMER for failure to perform the services due to events beyond its control, including but not limited to fires, floods,
governmental actions, changes in law, weather, traffic, or acts of God. CUSTOMER is responsible for any necessary permits, and agrees to pay any fines or fees associated with obtaining permits, or moving the dumpster in case a permit was not obtained and was required. Move fee is $200. If the driver believes placement will cause damage to property, container or vehicles: driver can refuse placement of container and suggest a more suitable location.
WEIGHT LIMITS. The weight limit for each dumpster size is defined above, any overweight load will be billed at $185 per ton, pro rated to the pound. If the load exceeds the legal limits of the container or vehicle, the customer must remove that weight sufficient to bring the load into legal compliance. If a customer refuses to do so, COMPANY reserves the right to dump all or any portion of the load on site.
WASTE MATERIALS. Customer warrants that the waste or materials in container hereunder will not contain any hazardous, toxic, radioactive, or any other substance prohibited by applicable federal, state, or local, laws or regulations. Customer agrees to indemnify, defend and hold harmless the company against all claims, costs, attorneys fees, damages, suits, penalties, fines and liabilities for injury or death to persons or loss or damage to property or the environment arising out of breach of the warranty stated above. The warranties and indemnities contained herein shall survive the termination of this agreement
Surchargeable items: Mattress (Any Size Including Stripped) $100, Box Springs (Any Size) $100, Computer Monitor/TV $50, Refrigerator/AC $50, Tires $50, Propane Tank $50. Prices are subject to change and are posted on our website.
Do not mix or load yard waste, brush, grass, leaves, asphalt, concrete, rock, brick, dirt, etc. into container. Contact company on how to manage and recycling aggregate waste.
HAZARDOUS MATERIALS. No liquids, batteries, paint, toxic materials, oils, hazardous waste materials, explosives, pressurized containers of any kind, or any items listed by City, State or Federal agencies with jurisdiction over the respective area.
PICK UP SCHEDULE. The container shall be picked up anytime of the day on the 14th day of the contract period if CUSTOMER has not made prior arrangements. After the end of the contract term, an additional rental charge of $10 per day will be applied to the account. If unable to pick up a container due to excessive load size, a portion of the load must be removed by CUSTOMER. If all excess debris is not removed, COMPANY may dump excess on site to collect said container.
Any and all additional charges incurred will be charged to the payment method used to pay for the rental. INITIAL:
